Legal Assistant (Serious & Catastrophic Injuries)

Job Purpose:

To be responsible in assisting Solicitors within the team in all aspects of litigated and non-litigated, serious or catastrophic personal injury claims.

Key Duties & Responsibilities:

  • Speak with new clients and/or their family or carers on the telephone at the beginning and throughout the case
  • To have a good working knowledge of The Civil Procedure Rules
  • To have a good working knowledge of the law, processes, procedure and case law surrounding personal injury litigation
  • Be proactive in the investigation of liability and quantum
  • To carefully review evidence and highlight inconsistencies
  • To accurately index and paginate records
  • To accurately prepare bundles for hearings and trial
  • To continuously risk assess a case as it progresses and highlight concerns to line manager
  • Be able to identify and flag to line manager where injuries are not recovering as anticipated or where injuries are worse than first thought particularly with regards to cases that have started as minor head injury cases
  • To identify the need for signposting to other organisations such as Headway
  • To identify the need for the claimant to be referred for a benefits check
  • To be able to identify other relevant policies or cover in place such as critical illness or permanent health and advise the client accordingly
  • To be willing to travel to and attend if required any Magistrates , Crown Court or Coroners Court for the hearing of any associated proceedings
  • Be able to obtain relevant and necessary evidence (medical or otherwise), liaising with medical experts as necessary, identify and request relevant discovery documents
  • Instruct Counsel, attend conferences, hearings and CMC’s, JSMs etc.
  • With support and supervision, be able to draft simple pleadings, applications, instructions, briefs and schedules of loss
  • Ensure any appropriate instructions are obtained from any relevant lay and/or insurance clients or their litigation friend where the client is a protected party
  • Prioritise urgent schedule entries and dealing with remainder of daily tasks on To Do list
  • Prioritise compliance with Court directions ensuring all directions are complied with in a timely manner in consultation with lead fee earner
  • Liaise with Professional Deputy and Case managers throughout the case
  • Engage with business development activities as required by your manager or Department Head of Department
  • Deliver an outstanding client service to ensure excellent client reviews post settlement
  • To attend client meetings as requested which can be anywhere in England/Wales

Experience & Knowledge:

  • Ideally minimum of 1 year experience running a case load of their own or experience of assisting with the running of a full case load.
  • Excellent client care skills, to include providing written and oral advice in a clear concise manner
  • This role requires someone with excellent communication skills in terms of both listening and speaking to clients and other professionals
  • This role requires someone with empathy, compassion and patience.
  • This role may require you do be available out of normal office hours to speak to clients from time to time
  • The ability to liaise and build up a rapport by using effective communication with all external agencies during the life of a claim including medical agencies, investigators, barristers etc
  • Good IT skills with a sound working knowledge of VF or a similar case management system and essential MS Office knowledge
  • Excellent time management and organisational skills, with a calm and methodical approach to work, and a flexible and adaptable attitude to resolving issues
  • An ability to perform under pressure
  • To know own limitations and when to ask for help and support
  • To immediately flag any mistakes or worries
