£100k Damages Saving Across Three Cases

Whilst the world of Defendant Credit Hire continues to pose daily challenges, few claim types consistently create as many headaches for insurers as moped credit hire claims.

Often the value of the damaged vehicle is relatively modest, but the associated claim can escalate quickly. What starts as a low-speed collision involving a scooter worth a few thousand pounds can develop into a six-figure damages claim once hire charges, injury allegations, storage, recovery, and associated losses are added.

Although the majority of claimants are genuine, moped claims can often display characteristics that warrant careful scrutiny.  It is absolutely vital, therefore that those on the defendant side of the fence have a robust and efficient strategy for dealing with these types of cases, ensuring that the genuine claims slide through the claims process with little friction, but where there is issue to be taken, a firm and investigative stances is adopted.

Case One

Involved a £20k hire claim, the usual storage and recovery and PAV in addition to a personal injury claim.    The claimant had alleged that our client had pulled out a of junction into his path; the Defendant had said that she was stationary and whilst there was some contact with her vehicle, the Claimant had simply dropped his bike to the floor.  On application by the Defendant summary judgment was entered in her favour.

 

Case Two

Involved £16k Credit Hire, the usual storage and recovery and PAV in addition to a personal injury claim.    The Claimant had alleged that the Defendant had reversed into his scooter.  The Defendant’s case was that he was stationary, and the Claimant ran into the back of him.  At trial, the claim was dismissed, costs ordered in the Defendant’s favour and the hire company added to the proceedings for the purposes of a non-party costs order.

Case Three 

Involved £21k Credit Hire, the usual storage and recovery and PAV in addition to a personal injury claim.  The Claimant had alleged that the Defendant struck his moped on entrance to a roundabout.  The Defendant stated that there were two mopeds involved and that the accident was induced.  A local resident whose house was close to the roundabout provided evidence to the fact that the Claimant had been involved in another similar type incident on the same roundabout only a few months prior.  The claim was discontinued.
